No permit needed for small cellular antennas

Israel's cellular service providers won't need permits to install small cellular antennas, Attorney General Menachem Mazuz ruled yesterday. That's because they aren't considered antennas at all for the purposes of Planning and Building procedures, he said. He did however also order that the subject be revisited by an inter-ministerial committee.

Mazuz's ruling followed a High Court petition from the Sane Cellular Forum, which challenged the legality of the Telecoms Law of 2002, ruling that small cellular antennas, no larger than 30/50/80 centimeters, didn't require a planning permit. This means that the cellular providers don't have to advise the public when installing them, while installation of a larger transponder does require a permit and public notice. Also, homeowners can't sue for compensation if a small antenna impairs the value of their property.
