Court: No state funds for Sderot homes under Qassam threat

The High Court on Monday rejected a petition by Sderot residents demanding that their homes be safeguarded by the state from Qassam rocket attacks.

The court also rejected the request by the rocket-weary Negev town's residents for financial compensation for people who had already protected their homes by personally funding the work.

igh Court justices ruled that the issue of safeguarding homes was to be settled by the government, as well as defining it was one that touched on the most essential and basic human rights.

The ruling stated that, "Even if it appears that it would have been better had a government policy been formulated long ago with regard to safeguarding Sderot, at this moment a government decision has been reached, and the given space for maneuver should be left in the hands of the government as an authority."

For more than seven years, Sderot has been subjected to ongoing rocket attacks by Palestinian militants in Gaza. One such strike killed a 47-year-old student at Sapir College near the town in late February.

A group of Sderot residents last year petitioned the court to compel the government to safeguard 800 Sderot cottages with tile roofs that are easily penetrable. Furthermore, the petition requested that the court order the government to include the necessary funding for this work in the proposed budget for 2008.

In February 2008, the government approved a plan to fortify 3,600 homes that are situated within a 4.5-kilometer range of the Gaza Strip against rocket fire.

The High Court justices stated in their ruling that the government has recently engaged in vigorous activity to formulate a policy for the safeguarding of homes in communities bordering on Gaza. As such, the justices said, the special circumstances in which Sderot residents live will cause the fortification work to be executed as soon as possible.
